With regard to the Gunn Slater Law Firm (K.K. Changes LLC) and the Simon Law Firm P.C. the entire trial court transcript comprising over three thousand (3,000) pages from the R.A., Sarah, Blake Anyan v Mercy Hospital East - Dr. Daniel McNeive birth injury claim has been recovered and is now available for review and download.
This trial court transcript is a gold mine for any future opposing counsel whereas it gives insight into the case theory framework. trial court strategy and presentation of several of the first and second chair litigators of Gunn Slater and Simon Law.
The cost of purchasing such an exhaustive trial court transcript would be in the thousands of dollars though as a result of expeditious open source intelligence gathering Albert B. Pepper Jr. d/b/a Phoenix Rising Productions LLC in his continued consumer advocacy, free range journalist modality presents the transcript to whomsoever at no cost - pro bono.
Both the Gunn Slater Law Firm and The Simon Law Firm P.C. did not practice candor with the public when they advertised the 48.1 Million dollar jury verdict knowing full well that the gross recovery amount was capped at 18.0 million (a 30.1 million dollar omission of fact). Therefore, Pepper in his consumer advocacy modality is going to impose an ethics tax upon the aforementioned firms through radical transparency of all the various elements that comprise the Anyan v Mercy - McNeive case in the interest of the public and consumer practicing due diligence.

But wait, there's more.....
The two most recent appellate briefs filed by the appellants and respondents in April / May of 2026 will also be uploaded and archived on Jury-Watch Org in the coming days. - Below is an excerpt and publishers commentary from the Appellant's Reply Brief : May 13, 2026
Publishers Commentary: One of he meritless arguments presented by defense counsel in the appellate brief dated 5/13/2026 was that the words "all the way to verdict" in a four line text message that capped the gross recovery in a "high/low agreement" meant that they would allow the jury to proceed to a verdict so that plaintiff counsel had a verdict number to market.
Herein is the exact verbatim statement extracted from pages 13-14 in the appellate brief prepared by: Kurt S. Oldenwald - Sandberg Phoenix
Excerpt: "Whereas Respondent believes the phrase meant the unadjusted verdict would be the trigger or base for what would become the amount to be paid, Appellants reasoned the phrase meant only that the jury would be allowed to continue to deliberate 'all the way' to a verdict on the bifurcated punitive damages argument which was consistent with Respondent's counsel's stated desire to Appellants' counsel to be in position to publicize and market the unadjusted amount of the verdict, even if the actual settlement amount was lower."
Publishers Polemic: This is the type of back room "sleaze litigation" that goes on when 1) The jury acting in good faith, sitting at trial for several days hearing evidence and arguments, who takes their sworn oath as venire panel members seriously, are in deliberations believing that all of the time and effort they put into the case through their civic duty will have an impact. 2) Injured parties who have been in litigation for years waiting for the final outcome of their claim are at the very height of how this long litigated claim will be resolved. But rather than focusing exclusively on what is best for their client these "sleaze bags" are worried about getting a jury verdict for marketing purpose because once this case is disposed of the clients are of no more value the the firm. It is the future clients that are inhabiting the thoughts of legal counsel.
"The choice of an attorney is an important decision and should not be based solely upon advertisements" --- And certainly not upon a 48.1 million dollar "ghost verdict" and a 30.1 million dollar "omission of fact" by plaintiff counsel Gunn Slater Law Firm - Simon Law Firm P.C.
